## Overview
Welcome to CalisFit™. In these Terms of Service, “CalisFit™,” “we,” “us,” and “our” refer to the operator of the CalisFit™ online store.
CalisFit™ operates this store and website, including the related information, content, features, tools, products, and services we make available to provide you with a shopping experience (the “Services”). The Services are powered by Shopify, which provides the technology that enables us to operate the store.
These Terms of Service, together with the policies referenced here, explain the terms that apply when you access or use the Services or purchase a product from us.
By visiting, interacting with, or using the Services, you agree to these Terms of Service and our [Privacy Policy](https://5mjxnm-kg.myshopify.com/policies/privacy-policy). If you do not agree, do not access or use the Services.
Nothing in these Terms of Service limits any consumer rights or other legal rights that cannot be waived or restricted under the laws that apply to you.
## 1. Access and Accounts
You must be at least the age of majority in your place of residence to make a purchase through the Services. If you allow a minor to use the Services on a device you own or manage, you are responsible for that minor’s activity.
You may be asked to provide information such as your email address, billing information, payment information, and shipping address. You agree that the information you provide is accurate, current, and complete, and that you are authorized to provide it.
You are responsible for maintaining the security of your account credentials and for activity that occurs through your account. You may not sell, transfer, or assign your account to another person.
## 2. Products and Product Information
We make reasonable efforts to describe and display our products accurately. Product colors and appearance may vary slightly depending on your device, screen, and settings.
Please review the product description, specifications, installation requirements, and stated load limits before purchasing. Product information may be corrected or updated from time to time. Any change made after an order is placed will not reduce rights or protections that apply to that order under applicable law.
We may limit the quantities of products available for purchase or discontinue a product. Any such action will not affect orders we have already accepted, except where a change or cancellation is permitted or required by applicable law.
## 3. Unlimited Warranty
The CalisFit™ Wall-Mounted Training Station is covered by our Unlimited Warranty for the original purchaser. “Unlimited” means that this commercial warranty has no fixed expiration date. It does not mean that every type of damage or loss is covered.
The Unlimited Warranty covers defects in materials or workmanship under normal, intended use, provided the product is installed, maintained, and used according to the instructions and stated load limits.
The Unlimited Warranty does not cover damage caused by misuse, abuse, accidents, unauthorized modifications, improper installation, installation on a wall or mounting surface that is unsuitable for the product or its load, failure to follow the instructions, exceeding stated load limits, or normal wear and tear.
To submit a warranty claim, email calisfit.usa@gmail.com with your order number, a description of the issue, and photos or video that help show the problem. We may request additional information to assess the claim.
If a claim is approved, we will provide a remedy available under this warranty and applicable law. Depending on the issue and the rights that apply to your purchase, a remedy may include replacement parts, repair, a replacement product, or a refund.
This Unlimited Warranty is in addition to, and does not replace or restrict, any legal consumer guarantees, warranties, or remedies that cannot be excluded or limited under applicable law.
## 4. Orders
When you place an order, you make an offer to purchase the products in your order and authorize us and our payment processors to charge your selected payment method for the total shown at checkout.
An order is accepted when we send an order confirmation or otherwise confirm acceptance. We may decline or cancel an order where permitted by applicable law, including if a product is unavailable, a payment cannot be authorized, or a material pricing or listing error has occurred. If we cancel an order after payment, we will issue any refund required by applicable law.
Please review your order before submitting it. We may be unable to cancel or change an order once it has been processed or shipped. This does not affect any cancellation rights you may have under applicable law.
Purchases are subject to our [Return and Refund Policy](https://5mjxnm-kg.myshopify.com/policies/refund-policy), which forms part of these Terms of Service. If that policy conflicts with a mandatory right under applicable law, the mandatory right applies.
## 5. Prices, Taxes, and Payment
The price charged for a product is the price displayed at checkout when you place your order. Prices and promotions may change, but changes will not alter the price of an order we have already accepted.
The checkout will show shipping charges and any taxes or other charges that we are required to collect and disclose. Depending on your location and the shipping destination, customs duties, import taxes, or other charges may be payable by you or may be collected at checkout. We will disclose such charges at checkout where required or where the amount is known to us.
You agree to provide current and accurate billing, payment, and contact information. You represent that you are authorized to use the payment method provided and agree to pay the total amount shown at checkout, including applicable charges.
## 6. Shipping and Delivery
Shipping and delivery dates are estimates unless we expressly confirm a guaranteed delivery date. Delivery times may be affected by the carrier, customs processing, weather, or other events outside our reasonable control.
We will provide shipping information in accordance with our Shipping Policy. Responsibility for a product that is lost or damaged in transit will be determined under applicable law. Nothing in these Terms transfers responsibility to you earlier than permitted by the laws that apply to your order.

## 7. Returns and Refunds
Returns, refunds, and exchanges are governed by our [Return and Refund Policy](https://5mjxnm-kg.myshopify.com/policies/refund-policy), subject to any mandatory rights that apply to your purchase.
For a voluntary change-of-mind return, any requirements concerning the product’s condition, original packaging, return shipping costs, and return authorization apply only where permitted by applicable law. Those requirements do not restrict a warranty claim or any non-waivable legal right.
## 8. Intellectual Property
The Services and their content—including CalisFit™ names and marks, text, graphics, and original images—are owned by CalisFit™, its licensors, or other rights holders and are protected by intellectual property laws.
These Terms allow you to use the Services for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, publish, or commercially use content from the Services without the required permission.
Purchasing a product does not transfer ownership of any intellectual property rights in that product or its design. Any rights in product designs, images, or other materials remain with their respective owners.
## 9. Optional Tools and Third-Party Services
The Services may provide access to tools, apps, payment providers, or other services operated by third parties. Those services are provided by their respective providers and may be subject to separate terms and privacy policies.

## 10. Relationship with Shopify
Shopify provides the platform that enables us to operate the Services. Purchases made through this store are transactions between you and CalisFit™.
Shopify is not the seller of CalisFit™ products and is not responsible for the sale between you and CalisFit™, except as required by applicable law. Nothing in these Terms releases CalisFit™ from its responsibilities to customers.
## 11. Privacy

## 12. Feedback and Reviews
If you submit feedback, suggestions, or other content to us, you give us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and adapt that content to operate, improve, and promote the Services.
You confirm that you have the rights necessary to submit the content and that it does not violate another person’s rights or applicable law. You remain responsible for your submissions. We may remove content where permitted by law or where it violates these Terms.
We will not present a review as coming from a customer if it does not, and we will make disclosures required by applicable law when reviews or endorsements are incentivized.
## 13. Errors and Updates
We may correct typographical errors, inaccuracies, or omissions in the Services. If an error materially affects an order we have received, we may contact you to confirm whether you wish to proceed at the correct information or cancel the order. If we cancel a paid order, we will issue any refund required by applicable law.
## 14. Acceptable Use
You may use the Services only for lawful purposes. You may not use the Services to violate applicable laws, infringe intellectual property rights, submit false or misleading information, interfere with the security or operation of the Services, or harm other users.
You may not upload malware or attempt to gain unauthorized access to the Services, our systems, or another person’s account. We may suspend or restrict access where reasonably necessary to protect the Services, users, or our business, subject to applicable law.
## 15. Suspension and Termination
We may suspend or terminate your access to an account or the Services where permitted by law, including if you materially violate these Terms or threaten the security or operation of the Services.
Ending access to the Services does not affect rights or obligations that arose before termination, including rights relating to an order, warranty claim, refund, or applicable consumer protection law.

We provide the Services and general information on the website on an “as available” basis, subject to applicable law.
The Unlimited Warranty in Section 3 applies to the product as described there. Nothing in this section excludes or restricts that warranty or any statutory consumer guarantee, legal warranty, or other right that cannot be excluded or restricted under applicable law.
## 17. Limitation of Liability
To the fullest extent permitted by applicable law, CalisFit™ will not be liable for indirect or consequential losses that were not reasonably foreseeable when the relevant contract was made.
Nothing in these Terms excludes or limits liability, rights, or remedies that cannot legally be excluded or limited. This includes any non-waivable consumer rights and any liability that applicable law does not allow us to exclude or limit.
## 18. Indemnification
You are responsible for losses directly resulting from your unlawful use of the Services or your intentional violation of another person’s rights, to the extent permitted by applicable law.
Nothing in this section makes you responsible for losses caused by CalisFit™’s breach of these Terms, negligence, product obligations, or any other matter for which you cannot legally be held responsible.
## 19. Severability
If a provision of these Terms is found unlawful or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue to apply, subject to any non-waivable rights under applicable law.
## 20. No Waiver; Entire Agreement
If we do not enforce a provision of these Terms immediately, that does not mean we waive the right to enforce it later.
These Terms and the policies they reference form the agreement between you and CalisFit™ concerning your use of the Services. They do not replace any mandatory rights or protections that apply to your purchase.
## 21. Assignment
You may not transfer your rights or obligations under these Terms without our written consent, except where applicable law provides otherwise. We may transfer our rights or obligations as part of a business reorganization or transfer, subject to applicable law and without reducing your rights.
## 22. Governing Law and Disputes
These Terms are subject to the laws that apply to the transaction and to CalisFit™. Any choice of law or court in these Terms does not remove mandatory consumer protections or a customer’s right to bring a claim in a court where that right is provided by applicable law.
## 23. Translations
We may make these Terms available in other languages for convenience. If translated versions differ, the English version will apply only to the extent permitted by applicable law. Any mandatory rights concerning language or local disclosures remain unaffected.
## 24. Headings
Headings are included for convenience and do not change the meaning of these Terms.
## 25. Electronic Communications
By using the Services or placing an order, you agree that we may send transaction-related and service-related communications electronically, including order confirmations, shipping updates, and replies to customer service requests.
This section does not constitute consent to receive marketing messages where separate consent is required by law.
## 26. Changes to These Terms
We may update these Terms by posting a revised version on the website. The revised version will state its effective date. Changes will apply to future use of the Services and future orders, and will not retroactively reduce rights relating to an order already placed, except where permitted by applicable law.
